GENERAL TERMS AND CONDITIONS
Article 1 (General)
1.1 These conditions apply to all offers, orders and agreements of Danspalen.nl. By concluding an agreement between the customer and Danspalen.nl in the manner described, the customer accepts the conditions.
1.2 Deviations from these conditions are only valid if they have been expressly agreed in writing with Danspalen.nl.
1.3 All rights and claims, as stipulated in these terms and conditions and in any additional agreements for the benefit of danspalen.nl, are also stipulated for the benefit of intermediaries and other third parties engaged by Danspalen.nl.
1.4 If provisions of these terms and conditions are null and void or are annulled, the other provisions of these terms and conditions will remain fully in force. Danspalen.nl and the customer will then enter into consultation in order to agree on new provisions to replace the null and void or annulled provisions, whereby the purpose and scope of the null and void or annulled provisions will be taken into account as much as possible. 1.5 Danspalen.nl has the right to change the terms and conditions and the content of the danspalen.nl websites at all times.
Article 2 (Offers and agreements)
2.1 All offers from Danspalen.nl are without obligation and Danspalen.nl expressly reserves the right to change prices, in particular when this is necessary based on (legal) regulations. All offers are based on availability. Price changes are reserved at all times.
2.2 An agreement is only concluded after acceptance of your order by Danspalen.nl. Danspalen.nl is entitled to refuse orders or to attach certain conditions to the delivery, unless expressly stated otherwise. If an order is not accepted, Danspalen.nl will notify this within five days after receipt of the order.
2.3 This agreement contains all agreements made between the customer and Danspalen.nl and replaces all previous agreements, arrangements and/or agreements between the customer and Danspalen.nl.
2.4 The administration of Danspalen.nl shall, subject to proof to the contrary, serve as evidence of the orders and payments made by the customer to Danspalen.nl and of deliveries made by Danspalen.nl. Danspalen.nl acknowledges that electronic communication can serve as evidence. By accepting the conditions, the customer also acknowledges this.
2.5 The order confirmation shall in any case contain the following information: a description of the product purchased by the customer and the number of products purchased by the customer; the price of the product; customer details such as name, home address, address to which the product is sent, the e-mail address and/or telephone number of the department of Danspalen.nl where the customer can go with questions about the order.
Article 3 (Delivery and delivery times)
3.1 The delivery times stated by Danspalen.nl are only indicative. Exceeding any delivery period does not entitle you to compensation or the right to cancel your order or terminate the agreement, unless the delivery period is exceeded to such an extent that you cannot reasonably be expected to maintain the agreement. In that case, you are entitled to cancel the order or terminate the agreement to the extent necessary.
3.2 Delivery of the products will take place at the place and time when the products are ready for shipment to you.
Article 4 (Prices and payment)
4.1 The prices stated for the products and services offered are in euros, including VAT and excluding handling and shipping costs. These shipping costs are charged separately per order and may differ per product. The delivery costs are stated in the product information.
4.2 Payment is made without discount or compensation by direct debit from a bank or giro account with the customer's permission at the time orders are processed for the customer.
4.3 If the customer fails to comply with the payment agreement, danspalen.nl is entitled to terminate the agreement with immediate effect without judicial intervention or to suspend its obligations, as well as to deny the customer access to the Danspalen.nl system without stating reasons.
4.4 Payments must be transferred in advance to the relevant account number of danspalen.nl. After payment has been received by Danspalen.nl, the product will be manufactured and/or shipped.
Article 5 (Reflection period / right of withdrawal)
5.1 When purchasing goods that are custom-made, the right of withdrawal lapses. 5.2 You can return your purchase within 14 days of receipt, provided it has not been worn or used (note, this does not apply to dance poles. DVDs and grip powders/lotions/spray can only be exchanged with unopened seal!). You will then receive the full purchase price including shipping costs back. If you return the item after 14 days, or if the item is worn or damaged, or is not in the original packaging, Danspalen.nl cannot accept the returned items and cannot refund your money. Clothing can only be returned if the original label/price tag has not been removed!
Article 6 (Force Majeure)
6.1 Danspalen.nl is not obliged to fulfil any obligation towards the customer if it is prevented from doing so as a result of a circumstance that is not its fault, nor for which it is responsible under law, legal act or generally accepted views.
6.2 Circumstances within the meaning of Article 5.1 include a business disruption, a disruption in the supply of energy or materials, transport delays, a strike and failure or late delivery by suppliers.
Article 7 (Ownership of products)
7.1 All items delivered to the customer remain the property of danspalen.nl until all amounts owed by the customer for the items delivered under the agreement have been paid in full to Danspalen.nl. The risk regarding the products is already transferred to you at the moment of delivery.
Article 8 - Intellectual and industrial property rights
8.1 The customer must fully and unconditionally respect all intellectual and industrial property rights that rest on the items delivered by Danspalen.nl.
8.2 Danspalen.nl does not guarantee that the items delivered to the customer do not infringe any intellectual and/or industrial property rights of third parties and accepts no liability whatsoever in the event of any claim by third parties based on the assertion that an item delivered by danspalen.nl infringes any right of a third party.
Article 9 (Liability)
9.1 You are obliged to examine upon delivery whether the products correspond to the agreement. If this is not the case, you must notify danspalen.nl thereof as soon as possible and in any case within ten days after delivery, or after the discovery was reasonably possible, in writing and with reasons.
9.2 If it has been demonstrated that the products do not comply with the agreement, Danspalen.nl has the choice to replace the products in question with new products upon return or to refund the invoice value thereof.
9.3 Danspalen.nl cannot be held liable for injury or damage incurred through the use of a Danspalen.nl product.
Article 10 (Orders and communication)
10.1 danspalen.nl is in no way liable for misunderstandings, damage, delays or unclear transmission of orders and messages as a result of the use of the internet or any other means of communication in the traffic between the customer and danspalen.nl, or between Danspalen.nl and third parties, insofar as this relates to the relationship between the customer and Danspalen.nl.
Article 11 (Personal data and privacy)
11.1 Personal data entered by the customer will be included in a file. This data will be used for the execution of the customer's order.
11.2 Only if the customer has indicated that he/she appreciates this, the customer's data will be included in a central file of danspalen.nl. This data will be used to keep the customer fully up-to-date regarding the matters and services of Danspalen.nl. The processing of the customer's data will take place in accordance with the applicable laws and regulations.
11.3 Payment details such as credit card, bank and giro account details of the customer will not be stored in any file by Danspalen.nl.
11.4 The customer may, if desired, obtain access to the data that Danspalen.nl records about the customer in the Danspalen.nl file. The customer is entitled to request changes to the data if this data is not correct.
Article 12(Warranty)
12.1 All products from danspalen.nl have a 6-month warranty.
12.2 The warranty does not apply to surface treatments that are visibly scratched by, for example, jewelry and/or footwear.
Article 13 (Miscellaneous)
13.1 If the customer provides danspalen.nl with an address in writing, Danspalen.nl is entitled to send all orders to the address in question until the customer has provided Danspalen.nl with a new address.
13.2 If danspalen.nl has permitted deviations from these conditions for a short or long period of time, either tacitly or not, this shall not affect its right to demand immediate and strict compliance with the conditions. The customer may never assert any right on the grounds that Danspalen.nl applies these conditions flexibly.
13.3 Danspalen.nl is authorized to use third parties in the execution of the customer's order(s).
13.4 The products are treated by an industrial coater and small imperfections such as dust and small scratches cannot be prevented. Of course we do our best to deliver the best possible product.
Article 14 (Applicable law and dispute resolution)
14.1 Dutch law applies to all offers, orders and agreements of Danspalen.nl.
14.2 All disputes between the parties will be submitted exclusively to the competent court in the Netherlands.
